JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-09-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Dhamdaha P.S. Case No. 137 of 2014 for offence under Sections 406, 420, 467, 468, 471 and 120(B) of the Indian Penal Code.
Accusation is that the petitioner no. 1 executed the sale deed on 22.05.2009 in favour of the informant Narayan Sah and his three brothers but later on the informant came to know that the aforesaid land was already sold to Rajesh Kumar Jha, Sanjeev Kumar Jha and Chiranjeev Jha in the year 1996 by the petitioner no. 1 and all petitioners came over the land and started to abuse
Patna High Court Cr.Misc. No.22960 of 2017 (4) dt.06-09-2017 2/2 and gave threatening.
Learned counsel appearing on behalf of the petitioners submits that the informant and his brothers have settled the dispute with the petitioners executing another sale deed of another land in favour of the informant and his brothers.
Learned counsel for the opposite party no. 2 also submits that the dispute has been settled as the petitioner has executed another sale deed in respect to same area of the land. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Purnea in connection with Dhamdaha P.S. Case No. 137 of 2014, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) khushbu/- U T
