The petitioner apprehends his arrest in Basantpur P.S. Case No. 408/2018, registered for the offences punishable under Section(s) 341, 323, 354, 504 and 34 of the Indian Penal Code. The informant alleged that the petitioner tried to outrage her modesty.
It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. The occurrence took place on 15.11.2018, but the F.I.R. was lodged on 19.11.2018. There is delay of four days in lodging of F.I.R and the informant has not given any plausible explanation for such delay. The time of occurrence is also not mentioned in the F.I.R. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in connection with Basantpur P.S. Case No. 408/2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Singh, J) vinita/- U R
