The petitioner seeks regular bail in connection with Nabinagar P.S. Case No. 53 of 2018, registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 307, 427, 435, 337, 379 and 504 of the Indian Penal Code.
The allegation in the present case is that a mob of about 200 persons had attacked the driver of a truck by which one child had been killed in an accident and thereafter, the said truck was also set on fire.
The learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. and there is general and omnibus allegation against a mob of unknown people of
Patna High Court Cr.Misc. No.76543 of 2018(2) dt.11-01-2019 2/2 two villages. It is further submitted that the petitioner has been falsely implicated in the present case and he is languishing in custody since 26.02.2018, however, he has been remanded in the present case on 14.08.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Nabinagar P.S. Case No. 53 of 2018.
