JUSTICE ASHUTOSH KUMAR ORAL ORDER 19-10-2020 Heard Mr. Kamal Kishore Singh, learned counsel for the petitioner and learned APP for the State. The petitioner, who is the younger brother of the husband of the deceased, seeks bail in connection with Saharsa P.S. Case No. 704 of 2019, dated 04.08.2019, instituted for the offences under Sections 304(B) and 201/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that

No.26966 of 2020(2) dt.19-10-2020 2/2 according to the own-showing, the informant has stated that his daughter had solemnized love marriage with the elder brother of the petitioner. He further submits that the deceased along with her husband stayed separately from the petitioner and except for the relationship between the husband of the deceased and him, there is nothing on record to justify his incarceration in custody.

The petitioner is in custody since 25.01.2020. The husband of the deceased is also in custody. Considering the facts afore-stated, the petitioner above-named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saharsa P.S. Case No. 704 of 2019. The application stands allowed.
