ANJANA MISHRA ORAL ORDER 21-01-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Section 7 of Essential Commodities Act.

Learned counsel for the petitioner submits that the petitioner is a Public Distribution System dealer and alleged recoveries of wheat and rice bags from his premises were meant for distribution under the Public Distribution System scheme. He further submits that the petitioner has not violated any provision rather the StockRegister annexed as Annexure-2 to this petition, indicates that they were valid stocks for which the register was being maintained.

No.45488 of 2015 (4) dt.21-01-2016 P2/2 Considering the nature of allegations and also the fact that the petitioner has no antecedent of the similar nature, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Raghunathpur P.S. Case No. 140/2015 subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
