In this case, the petitioner is seeking bail in connection with Raxaul Rail P.S. Case No. 12 of 2016 registered for offences under sections 47 of the Bihar Excise (Amendment) Act, 2016 / Section 34 of the Indian Penal Code. As per allegation made in the First Information Report, the police, while on duty in the train, saw two bags in suspicious condition. On search, from the plastic bag, 50 bottles, each containing 300 ml. liquor and from another bag, same kind of 42 bottles of liquor were recovered and the petitioner was arrested.
