The petitioner apprehends his arrest in connection with Saran Excise Case No. 35 of 2019, registered under Section 30(a) of the Bihar Excise Act.

The accusation is that on receiving secret information about selling of illicit liquor at Hasanpur Baniya, the informant being Excise Inspector and other officials reached there. On seeing the informant and other officials, two persons succeeded to flee away. On search, 48 bottles each containing 180 ml, 12 bottles each containing 375 ml, 47 bottles each containing 375 ml and 246 bottles each containing 180 ml of Indian made foreign liquor were recovered from the selling

Learned counsel for the petitioner submits that petitioner was not apprehended by the police at the spot but he has falsely been implicated in this case mere on suspicion. Further submission is that petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the 6th Additional Sessions Judge, Saran at Chapra, in connection with Saran Excise Case No. 35 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
