1. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of regular bail, arises out of Motipur Police Station Case No. 223 of 2023, dated 14.07.2023, disclosing offences under Section 341, 323, 302, 504, 34 of the Indian Penal Code.

3. As per the prosecution story, on 13.07.2023, in the evening, when the informant's son namely Raushan Kumar was returning home on a bicycle after purchasing fertilizer, in the meanwhile, all the accused persons including the petitioner surrounded him, abused him and assaulted him. It has further been alleged that co-accused Rajababu Ram assaulted the deceased by means of iron rod on his head due to which informant's son died in the hospital.

4. Learned counsel for the petitioner submits that there is specific allegation of assault against the co-accused Rajababu Ram. A general and omnibus allegation is alleged against the petitioner and others that they abused and assaulted the deceased with fist and slaps. Similarly situated co-accused persons have been granted bail by Co-ordinate Benches of this Court in Cr. Misc. Nos. 2275 of 2024, 35860 of 2025 and 914 of 2024. Petitioner is in custody since 29.11.2024.

Regards being had to the submissions made by the parties and taking into consideration the fact that the petitioner is in custody since 29.11.2024 and similarly situated co-accused persons have been granted bail by Co-ordinate Benches of this Court, accordingly, I am inclined to grant regular bail to the petitioner.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount, each to the satisfaction of learned Additional Sessions Judge, 3rd, Muzaffarpur in connection to the Motipur Police Station Case No. 223 of 2023, dated 14.07.2023.

8. This is subject to the condition that the petitioner

Patna High Court CR. MISC. No.22674 of 2025(3) dt.11-07-2025 3/3 shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
