Petitioner seeks bail in Shahpur P.S. Case No.324 of 2018 instituted for the offence under Section(s) 307, 353/34 Indian Penal Code and Sections 25(1-b)a, 26(i)(ii), 35 and 27 of the Arms Act.

In the written report, it is alleged that police got information that absconding accused, Brajesh Kumar Mishra, is hiding in the house of Hari Shankar Yadav with firearms. The police surrounded the house of Hari Shankar Yadav. The miscreants started making firing on the police party. The police also made firing. One of the miscreants got injured and was arrested by the police, who disclosed his name as Bajesh Kumar

Patna High Court CR. MISC. No.21499 of 2019(2) dt.05-04-2019 2/2 Mishra. It is further alleged that Brajesh Kumar Mishra disclosed the name of this petitioner as having absconded from the place of occurrence.

From the written report, it appears that he was not present. There is no recovery of incriminating article from possession of the petitioner.

Petitioner is in custody since 06.11.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, 14th, Bhojpur, Ara, in connection with Shahpur P.S. Case No.324 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner. (Sanjay Priya, J) J. Alam/- U T
