JUSTICE DINESH KUMAR SINGH ORAL ORDER 06/ 23-06-2017 The present application has been filed for quashing the order dated 28.12.2012, passed by Respondent No. 3, the Collector, Bhagalpur, whereby the appointment of the petitioner to the post of Anganbari Sevika, for Centre No. 123, Samudayik Bhawan Ganaura in the district of Bhagalpur has been cancelled. Further prayer has been made for quashing the order dated 30.05.2013, passed by Respondent No.

2, the Commissioner, Bhagalpur Division, whereby the order of the Collector has been affirmed.

The said order of Commissioner, Bhagalpur was challenged by respondent no. 6 in C.W.J.C. No. 16446 of

Patna High Court CWJC No.2151 of 2014 (6) dt.23-06-2017 2/2 2013, which was dismissed by a Bench of this Court, vide order dated 19.04.2016. Against the order passed in writ application, respondent no. 6 preferred L.P.A. No. 1152 of 2016, which was allowed by a Division Bench of this Court, vide order dated 10.04.2017 with a direction to appoint respondent no. 6 on the basis of the merit list prepared for appointment of Anganwari Sevika.

In view of the above factual position, learned counsel for the petitioner submits that this application has become infructuous and accordingly, seeks permission to withdraw this application.

Permission is accorded.

Accordingly, this application is dismissed as withdrawn.
