The petitioners seek pre-arrest bail in connection with Kumarkhand P. S. Case No. 119 of 2016 registered under Sections 341, 323, 379, 504, 506/34 of the Indian Penal Code. It is contended by the learned counsel for the petitioners that it is a case of over implication owing to land dispute going on between the parties. It is further contended that the petitioners have got no criminal antecedent. It is also contended that petitioner nos. 1 and 3 have been assigned the
Patna High Court Cr.Misc. No.21055 of 2017 (2) dt.06-07-2017 2/2 role of order giver.
Learned counsel for the State has opposed the prayer for grant of pre-arrest bail to the petitioners. Considering the submissions made above and the statement made in para-3 of the bail application that the petitioners have got no criminal antecedent, they are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Madhepura in Kumarkhand P. S. Case No. 119 of 2016, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks from today.
