A copy of the writ petition has already been served upon respondent nos. 2 & 3 on 22.09.2015 itself. Learned counsel for the petitioner is permitted to implead the Managing Director, The Motihari Central Co-operative Bank Ltd., Bank Road, Bhawanipur Zirat, Motihari, East Champaran as respondent no. 4.

Grievance of the petitioner is that the petitioner has retired from service after attaining the age of superannuation on 30.04.2011 itself, however no post retiral benefits like gratuity, leave

Patna High Court CWJC No.15582 of 2015 dt.05-05-2016 2/2 encashment, etc. have been paid to the petitioner till date, even though a representation was given by him to the respondent no. 4 i.e. Managing Director, The Motihari Central Co-operative Bank Ltd., Bank Road, Bhawanipur Zirat, Motihari, East Champaran vide Annexure-1.

Accordingly, this writ application is being disposed of with a direction to respondent no. 4 i.e. Managing Director, The Motihari Central Co-operative Bank Ltd., Bank Road, Bhawanipur Zirat, Motihari, East Champaran to take decision upon the representation filed by the petitioner with respect to payment of retiral dues. The admissible dues should be paid to the petitioner within a period of two months from the date of receipt/production of a copy of this order. If the claim of the petitioner is not found tenable, a reasoned order would be required to be passed by respondent no. 4 and communicated to him.
