JUSTICE SHIVAJI PANDEY ORAL ORDER 06-10-2016 Heard learned counsel for the petitioners and learned counsel for the State.

In this case, the petitioners are seeking bail in connection with Mushrak P.S. Case No. 94 of 2016 registered for offences under sections 147, 148, 149, 109, 341, 323, 324, 307, 307, 302 and 504 of the Indian Penal Code.

As per allegation made in the First Information Report, the younger brother of the Informant Sunil Sahani had gone to purchase fish at Baharauli Chawak at the shop of Shatrughan Sahani where some scuffle took place. An allegation has been made that the accused persons started to assault Sunil Sahni, brother of the Informant, on which the Informant tried to

Patna High Court Cr.Misc. No.43437 of 2016 (2) dt.06-10-2016 defend him and received knife injury on the left hand. Chandan Sahni assaulted Sunil Sahani, deceased, by iron rod on his head. Chhotu Sahani and Kameshwar Sahani caught hold the hands of the brother of the Informant and Shatrughan Sahni assaulted on his head by Sabal (Khanti).

In the First Information Report, nothing has been alleged against the petitioners.

Looking to the facts and circumstances of the case, let the petitioners, namely, Mohan Sahani, Tota Sahani @ Tola Sahani and Binod Sahani, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Assistant Chief Judicial Magistrate, 8th Saran in connection with Mushrak P.S. Case No. 94 of 2016.
