The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 302, 34 of the Indian Penal Code.

The prosecution case as per F.I.R is that on 09.06.2019 at about 8 p.m., while his wife, namely Kishnavati Devi and his sister-in-law went outside for defecation, co-accused Nagendra Ram tried to tease them but somehow, they managed to come to their house and narrated the whole story to the family

Meanwhile, Nagendra Ram armed with Farsa, Kamal Ram, armed with Tangi, Vidyasagar armed with lathi, Rabri Devi, the petitioner Ruman Devi came there and Nagendra Ram assaulted Surendra Ram with Farsa on his head, as a result of which, he sustained head injuries and subsequently died. When the informant's nephew Lalu Ram came to save then Kamal Ram assaulted on his head by Tangi as a result of which, he also sustained head injury.

It is submitted by learned counsel for the petitioner that petitioner is innocent and she has falsely been implicated in this case due to villager rivalry. It is further submitted that there is no allegation against the petitoner of assaulting the deceased Surendra Ram or injured Lalu Ram. There is general and omnibus allegation against the petitioner. Moreover, similarly situated co-accused has been granted anticipatory bail by a coordinate bench of this Court vide order dated 06.04.2021 passed in Cr. Misc. No. 26084 of 2020.

No.23199 of 2022(2) dt.29-09-2022 3/3 Considering the fact that petitioner is a lady and no specific allegation of making assault to the deceased or the injured has been alleged against the petitioner, let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-III, Gopalganj in connection with Bhore P.S. Case No. 197 of 2019, Sessions Trial No. 127 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
