The petitioner apprehends his arrest in a case registered for the offence punishable u/s 498(A), 304(B), 34 of the I.P.C.

As per the prosecution case, when the informant received a call on her mobile that Sagufata is no more and when the informant went to her daughter's house, he found that no one was at the house and the dead body of her daughter was lying on the palang. Thereafter, the informant stated that the petitioner was always tortured her for non-fulfillment of demand of dowry.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case due to grudge. The
Patna High Court CR. MISC. No.26294 of 2024(3) dt.12-07-2024 2/2 allegation leveled against the petitioner is not specific rather general and omnibus in nature. He has further submitted that there is no specific allegation leveled against the petitioner for assault and dowry demand and the petitioner lives separately from the family of the deceased since long time. Petitioner has no criminal antecedent.

Learned APP for the State opposed the prayer for bail.

Having regard to the facts and circumstances of the case, there is no specific allegation leveled against the petitioner for assault and dowry demand, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Hussainganj (M.H. Nagar) P.S. Case No. 163 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Anjani Kumar Sharan, J) Guddu/- U
