JUSTICE SANJAY PRIYA ORAL ORDER 12-01-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Sections 302, 201, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged in the written report by the informant that his son was murdered by the accused Fantus Yadav along with his father.

It has been submitted that the name of the petitioner has come during investigation as he has close relationship with both Fantus Yadav and the deceased.

The learned Sessions Judge, Bhagalpur, has also mentioned in the impugned order about such facts having come in the case diary. Besides such allegation of having close relationship of the petitioner with accused Fantus Yadav and the deceased Shivraj Yadav, there is no any other specific allegation

Patna High Court Cr.Misc. No.897 of 2017 (2) dt.12-01-2017 2/2 of overt act against the petitioner. The petitioner is a lady. It is stated that she along with her minor son is in custody since 20.8.2016.

Considering the aforesaid facts and circumstances of the case as also that the petitioner being a lady, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge-XIV-cumAdditional Chief Judicial Magistrate-XIII, Bhagalpur, in connection with Bath P.S. Case No. 86 of 2015, subject to the condition that both the bailors will be the close relatives of the petitioner (Sanjay Priya, J) S.Ali/- U T
