The petitioner, Ram Bachan Sah, is apprehending his arrest in a case of theft of electrical energy. There is allegation against the petitioner that at the time of raid, the petitioner was found consuming electrical energy as he was running a 5 HP Electric Motor of his Flour Mill by illegally tying a hook in the main line. The informant assessed the damage to the tune of Rs. 66,238/-.
The learned counsel for the petitioner submits that the son of the petitioner had applied for connection of LT line, but it appears that the connection was not given. The petitioner is ready to deposit the entire amount in two installments. Considering the facts aforesaid, let the above named petitioner, in the event of his arrest or surrender before the learned
Patna High Court Cr.Misc. No.2179 of 2015 (2) dt.19-01-2015 2/2 court below within a period of four weeks from the date of receipt / production of a copy of this order, be released on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabua in Ramgarh P.S. Case No. 183/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and on the condition that the petitioner shall deposit Rs. 36,238/- as first installment in the Electric Company before his surrender in court and the next installment shall be deposited after a month.
