JUSTICE SHAILENDRA SINGH ORAL ORDER 23-09-2025 The instant case (writ application) has been filed by the petitioner under Article 226 of the Constitution of India, seeking the following relief(s):

" A) For the issuance of appropriate writ/writs, order/orders, direction/directions to the concerned Respondent authorities to enter the name of petitioner in the revenue records of the land in question as the land in the revenue records of the Govt. is still

Patna High Court CWJC No.10296 of 2021(5) dt.23-09-2025 2/3 running on the name of petitioner's late father-in-law Rameshwar Baitha, B) For direction to the respondent concerned to decide the issue raised by the petitioner expeditiously and after completing the all formalities enter her name in Jambandi Register and to issue revenue receipt of the said land within a reasonable period.

C) For any other relief/reliefs to which the petitioner is found entitled under the facts and circumstances of the present case."

After some arguments learned counsel appearing for the petitioner seeks permission to withdraw this writ application with a liberty to approach the Director of Consolidation under the provisions of Section 35 of the Bihar Consolidation of Holdings and Prevention of Fragmentation Act, 1956 to challenge the order dated 19.02.1996 passed by the District Collector, Samastipur by which the Gift Deed No. 6293 dated 26.06.1990 executed by petitioner's husband in her favour, has been declared as null and void with cost.

3. Considering the aforesaid prayer, the instant writ application stands disposed of with aforesaid liberty to the petitioner. If she avails this liberty in the next 12 (twelve) weeks from today then the period spent by this petitioner in this writ

Patna High Court CWJC No.10296 of 2021(5) dt.23-09-2025 3/3 petition shall be excluded while computing the necessary limitation period, if any.
