Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 341, 323, 342, 448 and 307/34 of the Indian Penal Code, registered in connection with Riga P.S. Case No. 08 of 2020.

As per allegation, seven named accused persons assaulted the son of the informant and made him badly injured. He also assaulted the brother of the informant. The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.22939 of 2022(2) dt.10-10-2022 2/2 that there is case and counter case and the members of the defense side have also sustained grievous injuries and the petitioner is a person of clean antecedent.

On the other hand, learned APP for the State has opposed the prayer for anticipatory bail.

Considering the above facts and circumstances as well as the clean antecedent of the petitioner, let him above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rakesh Kumar, Judicial Magistrate 1st Class, Sitamarhi in connection with Riga P.S.Case No. 08 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
