Petitioner seeks bail in Maheshi P.S. Case No.142 of 2017 instituted for the offence under Section(s) 366-A/34 Indian Penal Code.

Counsel for the petitioner submits that victim has performed marriage with the petitioner. She is, at present, at the advance stage of pregnancy. Counsel for the petitioner has pointed out Annexure-3, which has been filed on behalf of the victim that both have married.

In the written report, there is allegation that this petitioner has kidnapped the victim girl.

Statement has been made that, now, girl is married

Patna High Court Cr.Misc. No.76050 of 2018(3) dt.20-02-2019 2/2 with petitioner and she is in advance stage of pregnancy. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the SDJM, Saharsa, in connection with Maheshi P.S. Case No.142 of 2017, subject to the condition that one of the bailors will be parents of the victim girl and another bailor will be parents of the petitioner. The victim girl will remain present at the time of furnishing bail bond on behalf of the petitioner. She will file Affidavit that she has performed marriage with the petitioner. (Sanjay Priya, J) J.
