The petitioner is languishing in custody for the offence punishable under Sections 304(B)/201 of the Indian Penal Code.

Petitioner is husband of the victim of dowry death. Marriage was solemnized 6-7 years prior to the unnatural death. Learned counsel for the petitioner submits that the petitioner has first child borne from the deceased in the year 2013. The victim committed suicide after hanging herself for family dispute and thereafter just to pressurize allegation of demand of dowry is there. Investigation of the case is already complete.

Considering the submission aforesaid and no material

Patna High Court CR. MISC. No.26129 of 2020(3) dt.04-12-2020 2/2 to suggest that the petitioner is going to tamper with the evidence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Gourichak P.S. Case No. 214 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
