JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-12-2018 The petitioner seeks regular bail in connection with Kasba P.S. Case No. 125 of 2018, registered for offences punishable under Sections 379 and 511 of the Indian Penal Code.

Allegation as per F.I.R. is that one person was arrested while stealing the motorcycle and he has disclosed the name of the petitioner. Further it appears that the petitioner is accused in 3 other cases. Impugned order further shows that from the house of the petitioner 3 motorcycles and 1 masker key for unlocking the motorcycle were recovered.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case. Though he is accused in 3 cases, but he is on bail in two cases and he is in judicial custody since 01.06.2018 in connection with this case.

Patna High Court Cr.Misc. No.74884 of 2018(2) dt.21-12-2018 2/2 Heard learned A.P.P. also, who opposed the prayer for bail of the petitioner.

Having heard both sides, in view of the above facts, at this stage, I am not inclined to grant bail to the petitioner. Accordingly, this application is dismissed.

However, the petitioner is at liberty to renew his prayer after framing of charge.
