JUSTICE ASHUTOSH KUMAR ORAL ORDER 02/- 24/07/2020 Heard Mr. Ganesh Prasad Singh, learned counsel for the petitioner and Mr. Nand Lal Kumar, learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Kudhani (Turki O.P.) P.S. Case No. 47 of 2020, dated 25.01.2020, instituted for the offences under Sections 414 and

34 of the Indian Penal Code and Sections 30(a), 38(1) and 41(1) of the Bihar Prohibition and Excise Act, 2016.

It appears from the F.I.R. that three vehicles were intercepted from where huge quantity of liquor was recovered. One person, who was arrested, disclosed the name of the petitioner also in the context of people who were instrumental in getting the consignment smuggled.

Learned counsel for the petitioner has submitted that except for the aforesaid statement, there is no other material to connect the petitioner with the offence and that the petitioner has clean antecedent.

Considering the facts afore-stated, the petitioner above-named, in the event of his arrest/surrender before the Court below within a period of six weeks from today, is directed to be released on bail on his furnishing bail-bond in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur in connection Kudhani (Turki O.P.) P.S. Case No. 47 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
