The present writ application has been filed seeking a direction upon the respondents to ensure payment of retiral benefits along with statutory interest as the petitioner superannuated from his service on 30.01.2020 for the post of Assistant Sub- Inspector. He submitted that while the petitioner was in service he was put to departmental proceeding and an ex-parte order was passed by the authorities vide order dated 29.02.20220 as contained in memo no. 829 whereby the petitioner was inflicted with the punishment of break up six

Patna High Court CWJC No.9902 of 2021(4) dt.12-12-2022 2/2 months increment of salary. He further submits that the petitioner was put to departmental proceeding and certain punishment have been passed.

After some arguments, learned counsel for the petitioner seeks permission to file a detail representation before the respondent no. 3 for ventilating his grievance. In view of the submissions made on behalf of the learned counsel for the petitioner, the writ application stands disposed of with a liberty to the petitioner to approach before the respondent no. 3 by filing a detail representation. If such a representation is filed within a period of six weeks from today. The respondent no. 3 shall consider the same and pass reasoned and speaking order expeditiously, preferably within a period of eight weeks thereafter.
