The petitioner seeks bail in a case instituted under Sections 147, 148, 149, 323, 385, 379, 307, 504 and 506 of the Indian Penal Code.
The prosecution story, in brief, is that the F.I.R. named accused persons including the petitioner took Rs. 1700/- from the pocket of the brother of the informant and Rs. 2000/- from the pocket of the informant on the point of pistol. It is further alleged that on objection raised by the informant, the accused persons assaulted the informant and his brother brutally and Chandan Mahto.
It has been submitted on behalf of the petitioner that the
Patna High Court Cr.Misc. No.53094 of 2016 (2) dt.08-12-2016 2/2 petitioner is in custody since 21.06.2016. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. It is a case and counter case between the parties. There is land dispute between the parties. The injury on the accused side has not been explained by the prosecution.
On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Bhagalpur in connection with Shahkund P.S.
