JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-11-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State as also the learned counsel for the opposite party no.2.

The petitioner apprehends his arrest in connection with Complaint Case No. 2216 of 2012 registered under Sections 498A and 379 of the Indian Penal Code and Section 4 of Dowry Prohibition Act.

Learned counsel for the petitioner submits that on the joint prayer made on behalf of the petitioner and the opposite party no. 2, the matter was referred to the Mediation Centre, Patna High Court, Patna, for settlement of dispute in between the petitioner

Patna High Court Cr.Misc. No.22843 of 2017 (4) dt.03-11-2017 2/2 and the opposite party no. 2, who are husband and wife, where the both parties appeared, while petitioner has expressed his desire to keep his wife/ Opposite Party No. 2 with full dignity and honour but she was not ready to live with the petitioner and wants to one time settlement, taking the advantage to the effect that petitioner has performed re-marriage with another lady.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Begusari, in connection with Complaint Case No. 2216 of 2012, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
