The present application has been filed seeking direction upon the respondents to pay to the petitioner his post retirement benefits including gratuity, pension , earned leave and general provident fund etc.

Learned counsel for the petitioner submits that though the petitioner superannuated from the post of driver

At this stage, learned counsel for the State submits that petitioner had never approached before any of the authority for ventilating his grievance.

On the other hand, learned counsel for the petitioner submits that if the writ application would be disposed of with a direction to the concern respondent to consider his claim and dispose of his representation, he would be satisfied.

In view of the aforesaid submissions, this writ application is disposed of with a direction to the petitioner to file a representation before the respondent no, 4 namely, Civil Surgeon cum Chief Medical Officer Jamui. If such a representation is filed within a period of four weeks, the same shall be considered and disposed of by reasoned and speaking order, preferably, within a period of eight weeks. It is needless to say that if the petitioner would be found entitled to the retiral benefits and other outstanding dues, the same shall be paid to him within the aforesaid period.
