The Petitioners apprehend their arrest in Sadar P.S. Case No. 503 of 2016 registered for the offences punishable under Sections 406, 409, 420, 467, 468, 471 and 120B of the Indian Penal Code.
It has been submitted on behalf of the petitioners that the petitioners are not at all concerned with the mode and manner of identification of the beneficiary, title of their property,
Patna High Court Cr.Misc. No.22900 of 2017 (2) dt.07-06-2017 2/2 fixation of award and finally disbursement of the award. It is further stated that all the misappropriation which is alleged to have happened has happened in the office of Land Acquisition Officer, Muzaffarpur as the allegation regarding giving award to wrong person without approval of the competent authority attracts the malfunctioning of the employees and officers of the Land Acquisition Office, and the petitioners have nothing to do with the alleged occurrence. It has been further submitted that the petitioners have already been transferred from Muzaffarpur Division.The petitioners have got no criminal antecedent.
Considering the aforesaid facts and circumstances of the case, let the petitioners named above in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Sadar P.S. Case No. 503 of 2016; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
