The sole petitioner , who is in custody since 29.4.2016 in Amour P.S. Case No. 16 of 2015 registered for the offence under Section 147/ 148/ 149/ 323/ 324/ 307/ 379 and 504 of the Indian Penal Code has prayed for grant of bail primarily on the ground that there was case and counter case in between the parties. He submits that on the same day on the report of the brother of the petitioner namely Saimu one another F.I.R. vide Amour P.S. Case No. 17 of 2015 was registered. He further submits that in the present case there is an allegation of giving blow by bhala on the back of the informant. He submits that there

Patna High Court Cr.Misc. No.40901 of 2016 (2) dt.05-10-2016 2/2 was no intention to kill . By way of referring to paragraph no. 3 of the petition learned counsel for the petitioner submits that petitioner is having clean antecedent.

Considering the fact that there was case and counter case in between the parties and clean antecedent of the petitioner let the petitioner Abdul Subhan @ Abdul Rahman @ Abdus Subhan be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Sri Awadhesh Kumar , Judicial Magistrate 1st Class, Purnea / concerned court in connection with Amour P.S. Case No. 16 of 2015.
