ANJANA MISHRA ORAL ORDER 22-01-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner, being the Mukhiya of the Village, is apprehending her arrest in connection with Sour Bazar P.S. Case No.481 of 2012 for allegedly having committed the offence under Sections 406, 409, 420, 467, 468 and 471 of the Indian Penal Code.

Learned counsel for the petitioner submits that the informant Prakash Ranjan Kumar as Regional Deputy Director of Education, Koshi Range, Saharsa has given a written information to the S.H.O., Saharsa P.S. stating that a large scale bungling has been caused in the special residential training programme of Baikalpik Nawachari Siksha Sambhag

Patna High Court Cr.Misc. No.45611 of 2015 (4) dt.22-01-2016 2/3 and in the said report, names of the officer and teachers have been given, who were said to be responsible for the aforementioned bungling.

Learned counsel for the petitioner submits that so far as the present petitioner is concerned, she was not named in the F.I.R., but later on, some mischievous elements got her name included by making statements during the course of investigation. He further submits that she is not directly involved in the misappropriation of any money and that a presumption has been drawn that since she was responsible for supervising the work, it was at her instance that the entire bungling has taken place.

Considering the nature of allegations made against the petitioner and the vague nature of allegation which has surfaced thereafter during the course of investigation, let the petitioner, above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa, in connection with Sour Bazar P.S. Case No.481 of 2012, subject to the
