2. The petitioner has preferred this application for grant of regular bail in connection with Nawada Town P.S. Case No. 190 of 2025 registered for the offences punishable under Sections 140(1) of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution story, the informant has alleged that on 15.02.2025, when his father went temple for the purpose of worship, meanwhile one Uday Kumar along with other co-accused persons came in four wheeler and kidnapped his father.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.22405 of 2025(2) dt.28-04-2025 2/3 petitioner is innocent and has falsely been implicated in this case. The victim Sanjay Kumar gave his statement before the police in para-15 of the case diary in which, no allegation has been alleged against this petitioner rather the petitioner roped in this case only because he is the driver of the said vehicle. It is also submitted that except confessional statement, no any material came against the petitioner and confessional statement before the police has no evidentiary value in the eye of law.
5. Learned A.P.P. appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

From perusal of the FIR, it is clear that the informant's sister Babli Kumari has been married with coaccused Uday Kumar and she has filed matrimonial case against her husband Uday Kumar and others in which, pairvi was being made by the father of the informant. All these facts clearly suggests that previous enmity is between both the parties and the petitioner is the driver as alleged and admitted by the petitioner.
7. Considering the aforesaid facts and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned
