1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Nadi Police Station Case No. 491 of 2022, dated 13.12.2022, disclosing offences punishable under Sections 366-A/34 of the Indian Penal Code.
3. The prosecution case, as per the First Information Report, is that the petitioner and other co-accused Santu Kumar kidnapped the daughter of the informant for the purpose of marriage.
4. Learned Counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He further submits that there was love affair between the petitioner and the victim girl and they have
Patna High Court CR. MISC. No.21198 of 2025(3) dt.14-08-2025 2/3 solemnized marriage and one child has born out of their wedlock. He further submits that the victim girl is the sister-in-law (sali) of the brother of the petitioner.

Learned Additional Public Prosecutor, referring to the case diary, submits that the victim girl was recovered by the police on 04.08.2024, having a child of ten months in her lap and on the next date, i.e. on 05.08.2024, her statement, under Section 164 of the Code of Criminal Procedure, 1973, was recorded, in which she has disclosed her age as 19 years and has further stated that she had gone to the house of her sister and later she solemnized marriage with the brother-in-law (devar) of her sister out of her own will.

Regards being had to the submissions advanced on behalf of the parties and taking into consideration the statement of the victim girl recorded under Section 164 of the Code of Criminal Procedure, 1973, mentioned in paragraph 45 of the case diary, I am inclined to grant the petitioner privilege of anticipatory bail.
7. This application is, accordingly, allowed.
8. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of
Patna High Court CR. MISC. No.21198 of 2025(3) dt.14-08-2025 3/3 four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna City, in connection with Nadi Police Station Case No. 491 of 2022, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
