Petitioner seeks bail in a case registered under sections 399, 402, 120B/34 of the Indian Penal Code and various sections of the Arms Act.

No doubt, petitioner carries criminal antecedent of near about six cases but in the present case neither the petitioner was caught on the spot nor anything was recovered from his conscious possession and it appears that name of the petitioner came in this case in the confessional statement of those co- accused who were arrested on the spot.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate,
