The petitioner seeks bail in Kiul Rail P. S. Case No. 101 of 2017 instituted for the offence under Section(s) 30(a), 38(1) of the Bihar Prohibition and Excise Act, 2016 . Learned counsel for the petitioner is permitted to make necessary correction in the bail petition in course of the day.

It has been submitted that one Maru Manal was apprehended with illicit liquor as mentioned in the seizure list which is part of the FIR. He disclosed before the police that he use to sale the same to this petitioner and other person. As such there is no recovery of illicit liquor from possession of this petitioner.

No.73225 of 2018(2) dt.07-12-2018 2/2 Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the IInd Additional District and Sessions Judge cum Special Judge (Excise), Lakhisarai, Dist. Lakhisarai, in connection with Kiul Rail P. S. Case No. 101 of 2017 subject to the condition that both the bailors shall be the close relative of the petitioner.

It is mentioned in para 3 of the bail petition that other cases of Excise Act are also pending against him. The petitioner will file affidavit at the time of filing bail bond that he would not indulge himself in such type of activities in future. If he is found indulged in such type of activity, his bail bond in the Court below will liable to be cancelled.
