KUMAR ORAL ORDER 06-06-2017 Heard learned counsel for the petitioner and the State. Petitioner is apprehending his arrest in Sasaram (T) (Model) P.S. Case no. 330 of 2017 for the offences registered under Sections 409, 420 and 120(B) of the Indian Penal Code. It is alleged that petitioner, who works as computer operator at counter no. 1 in the District Transport Office, in connivance with a middle man used to issue licence illegally and did not maintain the distribution register properly. Besides, from the counter of petitioner shortage of cash collection was found. It has been contended on behalf of the petitioner that he has got no criminal antecedent. He has falsely been implicated in the present case due to office politics. He has not committed
Patna High Court Cr.Misc. No.22814 of 2017 (3) dt.06-06-2017 2/2 any criminal offence nor anything was recovered from his possession. The deficit amount has already been deposited in the bank. No case under Sections 409 and 420 of the IPC has been made out against the petitioner.
Considering the facts and circumstances of the present case, let petitioner, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas, Sasaram, in connection with Sasaram (T) (Model) P.S. Case no. 330 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
