This is the second attempt on behalf of the petitioner for grant of anticipatory bail in connection with Rajepur P.S. Case No. 173 of 2023 registered for the offence under sections 304-B, 302, 201/34 of the Indian Penal Code. 3.

Earlier, the prayer of the petitioner for grant of bail has been withdrawn vide order dated 10.04.2024 passed in Criminal Miscellaneous No.80772 of 2023. The petitioner, after lapse of one year, has renewed her prayer for anticipatory bail stating that her son, who is the husband of the deceased, was put on trial and has been acquitted.

The allegation against the accused persons including the petitioner is of killing the deceased.

The petitioner's anticipatory bail was rejected one year back and she has chosen not to surrender before the Court below and is an absconder also. She waited for the trial of her son to be concluded. When earlier the prayer of the petitioner for grant of anticipatory bail was already rejected, the second anticipatory bail on her behalf is not maintainable. 6.

In view of the aforesaid, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this bail application is rejected. The petitioner is directed to surrender before the Court below within four weeks from today, failing which, the Superintendent of Police, East Champaran will take all steps for arrest of the petitioner.
