====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 21-01-2015 Heard both sides.

The petitioners are apprehending their arrest in a case registered under Section 323 and other sections of the Indian Penal Code and Section 3(1)(X) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities Act).

The informant made omnibus and general allegations of assault against the petitioners and also alleged that the petitioners abused the informant and others by naming their caste. Learned counsel for the petitioners submits that the informant himself stated in his Fardbeyan that the occurrence took

Patna High Court Cr.Misc. No.2954 of 2015 (2) dt.21-01-2015 2/2 place on account of land dispute. The allegations of abusing by naming the caste and assaulting the informant and others are ornamental. Some altercations took place between the parties on account of land dispute. The informant and others have got some injuries.

Having considered the fact that the occurrence took place on account of land dispute, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in Srinagar P.S. Case No. 100/2013, G.R. No. 2123/2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
