JUSTICE RAKESH KUMAR ORAL ORDER 30-09-2016 Heard Sri Radha Mohan Singh, learned counsel who was assisted by Sri Ramesh Kumar Singh, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner who is in custody since 31.7.2016 in Forbesganj (Simraha) P.S. Case No. 379 of 2016 registered for the offence under Section 47(a)(d) of the Bihar Excise (Amendment) Act 2016 has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that petitioner has falsely been implicated on an allegation of recovery of about 22 bottles of foreign liquor each containing 750 ml.

Keeping in view the nature of accusation, period of custody as well as clean antecedent which has been indicated in

Patna High Court Cr.Misc. No.40809 of 2016 (2) dt.30-09-2016 2/2 paragraph no. 3 of the petition, let the petitioner Bhatan Singh be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria / concerned court in connection with Forbesganj (Simraha ) P.S. Case No. 379 of 2016.
