Mr.Sri Ashok Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-12-2018 The petitioner seeks bail in connection with Ara Nagar P.S.Case No. 452 of 2018 registered under Sections 366A, 504 and 506/34 of the Indian penal Code.
Allegation against the petitioner is of kidnapping the minor daughter of the informant.
Submission of learned counsel for the petitioner is that statement of the victim girl recorded under Section 164 Cr.P.C. itself shows that she is a consensual party and thereafter on the pressure of the guardian, she has stated against the petitioner though she never raised any objection while gone to Patna and thereafter Tata and petitioner has no criminal antecedent. Heard learned APP also.
Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, be released on bail upon furnishing bail bond of Rs. 25,000/-
Patna High Court Cr.Misc. No.76501 of 2018(2) dt.21-12-2018 2/2 (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Bhojpur at Ara in connection with Ara Nagar P.S. Case No. 452 of 2018 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
