The Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 307/34 of the Indian Penal Code, pending in the Court of learned Additional Chief Judicial Magistrate-VII, Nalanda at Biharsarif/Successor Court..

The petitioner is full brother of the informant. A civil suit is going on for partition of the family property. In the aforesaid background allegation is that petitioner fired at the informant causing injury at his hand.

Submission of the learned counsel for the petitioner is

Patna High Court Cr.Misc. No.22874 of 2017 (3) dt.01-07-2017 2/2 that simple injury has been found by the doctor on non-vital part of the body.

Considering the nature of allegation against the petitioner, this is not a fit case for anticipatory bail. Hence, prayer for anticipatory bail is refused.
