JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-02-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
Petitioners apprehend their arrest in connection with Complaint Case No. 1502-C of 2012 in which, cognizance has been taken for the offence punishable under Section-420 498A, 494 of the Indian Penal Code and Section-4 of Dowry Prohibition Act.
The petitioner No. 1 is husband whereas; rest petitioners are in-laws of the complainant. At the very outset, it is pointed out on behalf of the petitioners that for the same occurrence, the informant lodged Gopalpur P.S. Case No. 48 of
Patna High Court Cr.Misc. No.5020 of 2015 (2) dt.05-02-2015 2/2 2013, suppressing the fact of filing of the present complaint case and petitioners have already been granted privilege of bail in Gopalpur P.S. Case No. 48 of 2013 by a coordinate bench of this court.
Considering the above-said facts and circumstances as well as submission of the parties, this anticipatory bail petition is allowed and it is ordered that the petitioners named-above, in the event of arrest or surrender in the court below within four weeks from today, will be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Complaint Case No. 1502-C of 2012 to the satisfaction of Chief Judicial Magistrate, Bettiah, West Champaran.
