====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 04-07-2025 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
2. The petitioners are apprehending their arrest in connection with Neura P.S. Case No. 210 of 2024 dated 31.10.2024 registered for the offences punishable under Sections 126(2), 115(2), 109, 352 read with Section 3(5) of the B.N.S., 2023.
3. As per the prosecution case, on 31.10.2024 at about 7.00 P.M., the petitioners and other accused persons came at the house of the informant with arms and started abusing and

No.25130 of 2025(2) dt.04-07-2025 2/3 assaulted the informant with lathi-danda and when his nephew Chandan Kumar came to rescue him the accused persons assaulted with pistol on his head causing head injury. On hulla, nearby people came and pacified the matter and the injured Chandran Kumar brought to P.H.C., Bihta for his treatment from where he was referred to P.M.C.H., Patna for his better treatment.
4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. It is further submitted that there is general and omnibus allegation against the petitioners. There is no specific allegation against the petitioners. There is case and counter case between the parties. There is land dispute between the parties. There is no repetition of lathi blow on the injured. The doctor has examined the injured Chandan Kumar and found the injury nos. 1 and 2 are grievous and the injury nos. 3, 4 and 5 are simple. The petitioner nos. 1, 3 and 4 have clean antecedent and the petitioner no. 2 has one criminal antecedent as stated in paragraph no. 3 of the bail application.
5. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioners.
6. Considering the aforesaid facts and circumstances
Patna High Court CR. MISC. No.25130 of 2025(2) dt.04-07-2025 3/3 of the case, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV, Danapur, Patna in connection with Neura P.S. Case No. 210 of 2024, subject to the condition as laid down under Section 482(2) of the B.N.S.S, 2023.
(I) The petitioner nos. 1 to 3 except the petitioner no. 4, Pramila Devi, are directed to remain physically present before the learned court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner nos. 1 to 3 are liable to be cancelled.
7. The application stands allowed.
