Petitioner happens to be husband of the deceased. The deceased died within five months of her marriage. There is allegation of torturing as well as illegal demand. The post mortem report of the deceased goes to show that cause of death of the deceased was consumption of poison and, therefore, the aforesaid fact goes to show that the death of the deceased was other than in normal circumstances.
Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with
Patna High Court Cr.Misc. No.38708 of 2016 (3) dt.15-11-2016 2/2 Session trial no. 224 of 2016, arising out of Tajpur P.S.Case No. 364 of 2015, pending in the court of Additional Sessions Judge-II, Samastipur, stands rejected.
However, petitioner may renew his prayer for bail, if his trial is not concluded within nine months from the date of receipt/ production of a copy of this order in the court below. (Hemant Kumar Srivastava, J) N.K/- U T
