JUSTICE SANDEEP KUMAR ORAL ORDER 22-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Sarai P.S. Case No. 395 of 2022, registered for the offence punishable under Section 304(B)/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is innocent and falsely been implicated in this case at the instance of her enemies. It is further submitted that the deceased was a short tempered lady and after four years of marriage there was no issue as such she was living in depression and she committed suicide. It is further submitted that petitioner is 70 years of age and husband of deceased was separate from his brother by mess and means. Petitioner has no criminal antecedent. Petitioner is in custody since 07.12.2022.

Patna High Court CR. MISC. No.23426 of 2023(2) dt.22-05-2023 2/2 Learned APP has vehemently opposed the prayer for bail.

Considering the nature of allegation levelled against the petitioner, his period of custody, this application is allowed. Let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-VI, Vaishali at Hajipur in connection with Sarai P.S. Case No. 395 of 2022.
