JUSTICE SUDHIR SINGH ORAL ORDER 22-11-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with a case registered under Sections 147,148, 149, 341, 342, 323, 324, 326, 337, 338, 332, 333, 307, 353, 427, 395 of the Indian Penal Code and 3 Damage to Public Property Act.
The accusation is that he along with several other accused persons attacked on the informant and other police officials and not only they assaulted the constables but also snatched one loaded rifle from one SAP Jawan. The aforesaid rifle was, later on, recovered from the possession of co-accused Chhotu Kumar.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 01.09.2016. The petitioner has got no
Patna High Court Cr.Misc. No.50317 of 2016 (2) dt.22-11-2016 2/2 criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. The name of the petitioner has been disclosed in the FIR by the co-accused. The petitioner has not been put on T.I. parade. There is no recovery of any incriminating article from the possession of the petitioner. Other co-accused have been granted bail vide Cr. Misc. No. 20126 of 2016, Cr. Misc. No. 43391 of 2016, Cr. Misc. No. 27940 of 2016 and Cr. Misc. No. 22877 of 2016.
On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya in connection with Buniayadganj P.S.Case No.02 of 2016.
