JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-07-2023 In compliance of order dated 14.07.2023, the Superintendent of Police, Munger has submitted a report dated 19.07.2023, which is at flag 'C'. On perusal of the same, it appears that the victim has been recovered on 13.10.2022 by the S.I.T. from Ektanagar, Jalandhar (Punjab) and she was produced before the Court on 15.10.2022, where her statement under Section 164 Cr.P.C. was recorded and thereafter, she was handed over to her cousin father-in-law (chachiya sasur). From the report, it also appears that the victim is living with her husband namely Ajay Kumar at Ekta Nagar, Jalandhar (Punjab).
2. By filing supplementary affidavit, it is submitted by learned counsel for the petitioner that after recovery of the
Patna High Court CR. MISC. No.30506 of 2023(3) dt.21-07-2023 2/2 victim at Jalandhar, she was medically examined and thereafter, her statement under Section 164 Cr.P.C. was recorded. The doctor has assessed her age between 18 - 19 years. So far as both petitioners are concerned, they are relatives of co-accused Ajay Kumar, with whom, the victim has solemnized marriage.
3. Considering the statement of the victim recorded under Section 164 Cr.P.C., the prayer for anticipatory bail of petitioners is allowed. Let the above-named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of court of learned A.C.J.M. - II, Munger in connection with Bariarpur P.S. Case No. 10 of 2022, subject to condition as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Singh, J) anay/- U T
