JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-10-2021 The present petition has been filed seeking quashing of the order dated 01.05.2020 passed by the Sub-Divisional Offfcer, Masaurhi, Patna, whereby and whereunder the license of the PDS shop of the petitioner bearing License No. 76 of 2016 has been cancelled.

At the outset, the learned senior counsel for the petitioner Shri N.K. Agrawal assisted by Ms. Preety Kunwar seeks liberty on behalf of the petitioner to file appropriate appeal under Rule 32(iii) of the Bihar Targeted PDS (Control) Order, 2016.

The Ld. Counsel for the respondent State, Shri Alok Ranjan, AC to AAG-5 has got no objection. Having regard to the facts and circumstances of

Patna High Court CWJC No.9178 of 2020(2) dt.28-10-2021 2/2 the case, the present writ petition stands disposed off with liberty to the petitioner to approach the appellate authority by filing appropriate appeal against the aforesaid order dated 01.05.2020 and in case such an appeal is filed within a period of four weeks from today, the appellate authority shall consider the same on merits and dispose it of, in accordance with law, by a reasoned and a speaking order, within a period of eight weeks, thereafter.
