JUSTICE RAVI RANJAN ORAL ORDER 18-04-2016 I have heard learned counsel for the petitioner, the State and the informant.
The petitioner apprehends his arrest in a case registered for offences punishable under Sections 420, 120B/34 of the Indian Penal Code.
As per allegation the petitioner has allegedly sold the lands which fell into the share of the informant whereas the petitioner's claim is that he has sold the land which was allotted to him. It is contended that two title suits have already been filed for annulment for the sale deeds executed by the petitioner. Thus, it is urged that it is civil nature of matter. It is further submitted that the dispute whether the

No.45772 of 2015 (6) dt.18-04-2016 petitioner sold his share of land or the share of informant cannot be decided in this proceeding rather the same is required to be decided by the Civil Court of competent jurisdiction. Having regard to the facts and circumstances of the case, let the petitioner, namely, Ramakant Singh be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Muffasil P.S. Case No. 174 of 2015, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
