This is a petition for grant of anticipatory bail for offence under Sections 420, 467, 468, 471, 504 and 506/34 of the Indian Penal Code.

The petitioner is purchaser through registered sale deed from co-accused, Satyendra Kumar Srivastava. Allegation is that Satyendra Kumar Srivastava had sold the land of the informant whereas submission of the petitioner is that Satyendra Kumar Srivastava is cosharer of the informant and had bonafide title. If the allegation is assumed to be correct, the petitioner has been cheated in the transaction and not the complainant.

Considering the aforesaid fact, the petitioner,

Patna High Court Cr.Misc. No.19863 of 2017 (2) dt.28-04-2017 2/2 above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Isuapur P.S. Case No. 90 of 2016 to the satisfaction of the Additional Chief Judicial Magistrate, VI, Saran at Chapra, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
