JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-11-2023 The present writ petition has been filed seeking the following relief:- "1. That the present writ petition is being filed for issuance of appropriate writ / writs, order / orders, direction/directions to the Authority concerned to consider the case of the petitioner for regularization and the reasoned order may pass according to law because other persons have already been regularized by the same department who were also working in the department and they have been appointed as daily wages and name of the petitioner is also at serial no. 46

Patna High Court CWJC No.6235 of 2022(2) dt.23-11-2023 2/3 and he was working since 06.06.1982 and he has come in Work Charge Establishment on 02.01.1991, The service book of the petitioner has also opened by the authority.

So the ground which has been taken by the Authority concerned to regularize the other person's, the Department has passed the order on 23.09.2014 under the signature of the Chief Engineer the petitioner should be regularized as per the above fact your Lordship may pass appropriate order."

After some arguments, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Chief Engineer (Mechanical), Water Resources Department, for redressal of his aforesaid grievances. Liberty, so sought, is granted.

At this juncture, the learned counsel for the petitioner submits that the respondent authorities be also directed to consider the fact that other similarly situated employees have been regularized vide Annexure-7 to the present writ petition.

It is directed accordingly.
